Ratio Decidendi

The court found that the dispute as pleaded was fundamentally about the boundary between the Plaintiffs' and Defendant's parcels of land. The Plaintiffs sought confirmation of the position of beacons (boundaries) and related reliefs, which could not be granted without first determining the correct ground position of the boundary. Under Section 18(2) of the Land Registration Act 2012, such disputes must first be determined by the Land Registrar, and there was no averment that this had occurred. Therefore, the court's jurisdiction had been prematurely invoked. The preliminary objection was upheld, and the suit was struck out with costs to the Defendant.
