Procedural Posture

Notice of Motion / Ruling on Interlocutory Injunction

  1. 1 Whether the Plaintiff/Applicant has established a prima facie case with a probability of success to warrant the grant of a temporary injunction.
  2. 2 Whether the Plaintiff/Applicant will suffer irreparable injury not compensable by damages if the injunction is not granted.
  3. 3 Whether the balance of convenience tilts in favour of granting or refusing the injunction.

Ratio Decidendi

The court found that at the interlocutory stage, it was not possible to conclusively determine whether the Defendant was occupying the Plaintiff's suit property or his own Plot No. 755, as both parties presented conflicting evidence and the company central to the dispute was not a party to the suit. The Plaintiff failed to establish a prima facie case with a probability of success sufficient to warrant the grant of a temporary injunction. However, to preserve the subject matter of the suit, the court ordered that the status quo prevailing on the suit property be maintained pending the hearing and determination of the main suit.

Court Disposition

application for temporary injunction dismissed; status quo to be maintained

Orders

  • The application for a temporary injunction is dismissed.
  • The parties are ordered to maintain the status quo presently prevailing on the suit property pending the hearing and determination of the suit.
