Ratio Decidendi

The court found that the deceased's monthly income was Ksh.50,000 and that a multiplier of 6 years was appropriate given the deceased's age and life expectancy. The court adopted a 1/3 dependency ratio, considering the deceased's occupation and the plaintiff's inability to continue the deceased's work. The court calculated the loss of dependency as Ksh.1,200,000 (50,000 x 1/3 x 12 x 6). The court also awarded agreed sums for loss of expectation of life (Ksh.70,000) and pain and suffering (Ksh.10,000). After deducting 20% for the plaintiff's share of liability, the net award was Ksh.924,000 plus costs and interest.
