The evidence showed that the Plaintiffs' interest was limited to Blue Kongo Hotel Ltd, and not the disputed property or other companies. Previous affidavits and pleadings by the Plaintiffs expressly disclaimed any interest in LR No. 209/136/119, and there was no evidence of shareholding or beneficial interest in the other companies. The Plaintiffs' claim was therefore an afterthought following their inability to execute a previous judgment, and the suit was dismissed with costs to the Defendant.
