Ratio Decidendi

The High Court found that the doctrine of functus officio applied because the Trial Magistrate had already delivered a final judgment on 4th October, 2018, making the court functus officio and precluding it from revisiting the merits of the case or striking out the suit for want of jurisdiction. The court further held that the MV Kilindini is a ferry, not a ship, and thus the subordinate court had jurisdiction under the Ferries Act, not under admiralty jurisdiction reserved for the High Court. The lower court erred in striking out the suit after judgment had been entered, and the original judgment was upheld.
