The court found that the subdivision and transfer of land parcel Bukhayo/Bugengi/7892 into Bukhayo/Bugengi/10073 and 10074 was carried out after the tribunal award had been adopted as a judgment of the court and while execution proceedings were pending. The application before the lower court sought to restore the land register to its status as of 6th March, 2009 to enable execution of the award. The trial magistrate's orders were therefore within jurisdiction and did not amount to sitting on appeal of her own decision.
