The Court of Appeal held that the High Court bench which heard and determined the appellant's first appeal was not properly constituted because it included a judge of the Industrial Court, a specialized court whose judges have jurisdiction limited to matters assigned to that court by statute and the Constitution. The participation of such a judge in a criminal appeal rendered the proceedings a nullity. The Court found no new circumstances to depart from its previous decision in Karisa Chengo & 2 others v. Republic, which had declared similar proceedings a nullity. Consequently, the Court of Appeal declared the High Court's decision a mistrial and directed that the appeal be heard afresh...
