The court found that the Kigumo Land Disputes Tribunal acted without jurisdiction in entertaining a dispute relating to the sale and title of land, as such matters fall outside the scope of Section 3(1) of the Land Disputes Tribunals Act. Furthermore, the application before the Tribunal was time-barred under both contract and land recovery limitation periods set out in the Limitation of Actions Act, as the events occurred over sixteen years prior. The Tribunal's award was therefore incompetent and liable to be quashed. The High Court, exercising its supervisory jurisdiction, granted orders of certiorari to quash the Tribunal's proceedings and award, and prohibition to restrain further...
