Ratio Decidendi

The court found that the Chief Magistrate at Kajiado has both territorial and pecuniary jurisdiction to hear and determine the dispute in Kajiado CMCC No. 792 of 2015, as the value of the land is less than Kshs. 20 million and the Chief Magistrate is in charge of the whole of Kajiado County, including Loitoktok where the suit land is situated. The Senior Resident Magistrate at Loitoktok Law Courts, with a lower pecuniary jurisdiction, would not be competent, but the Chief Magistrate at Kajiado is legally capacitated. Therefore, there was no sufficient ground to transfer the suit to the Environment and Land Court, and the application was declined.
