Ratio Decidendi

The Tribunal found that the tenant was in breach of the tenancy agreement dated 8th September 2014, which specified the permitted use of the premises as an Mpesa/Agent Equity shop and prohibited use considered dangerous by the landlord. The sale of cooking gas constituted a change of user and was not permitted under the agreement. The landlord followed the statutory procedure by issuing a notice in the prescribed form and specifying the grounds for termination. The tenant failed to provide evidence of having the necessary licenses or that the sale of gas was permitted under the tenancy. Consequently, the landlord was entitled to terminate the tenancy and take possession of the premises.

Court Disposition

Tenant to vacate premises; landlord to take possession; each party to bear own costs.

Orders

  • The tenant shall on or before the 30th of January 2022 vacate the said premises and remove all his items.
  • The landlord shall take possession of the suit premises commencing 1st February 2022, failure to which he may break in with the OCS Wang'uru Police supervising and keeping the peace.
