Although the High Court has unlimited territorial and pecuniary jurisdiction, statutory provisions and administrative directions require that suits concerning immovable property be filed in the court within whose territorial jurisdiction the property is situated. The Kimilili Senior Resident Magistrate’s Court, where the original suit was filed, falls within the jurisdiction of the High Court at Bungoma as per Gazette Notice No.299 of 19th January 2007. Therefore, the application for transfer of suit ought to have been filed before the High Court at Bungoma, not Busia.
