Ratio Decidendi

The court found that the claimant failed to prove that he was unlawfully or unfairly terminated from employment. The evidence showed that the claimant tendered his resignation, which was accepted by the respondent, thereby severing the employment relationship. The court held that, in law, once resignation is accepted, there is no employment relationship left to terminate, and any purported dismissal is null and void. The claimant did not discharge his burden of proof under section 47(5) of the Employment Act, 2007. Consequently, the claim for unfair termination and related reliefs failed.
