Ratio Decidendi

The court found that the claimant was employed under the Board of Governors' terms, not public service terms, from 30th November 2007 onwards, and was therefore estopped from claiming salary underpayments after that date. However, the claimant was entitled to salary underpayments accrued before the change in terms. The respondent failed to prove the reasons for termination as required by Section 43(1) of the Employment Act, 2007, and did not follow the mandatory disciplinary procedure under Section 41. Consequently, the termination was deemed unfair under Section 45. The claimant was awarded compensation equivalent to three months' salary, notice pay at the rate of 15 days per completed...
