Ratio Decidendi

The court held that there is no legal basis for transferring the appeal from the Mombasa High Court to the Nairobi High Court. The provisions of sections 12, 13, 14, and 15 of the Civil Procedure Rules relate to the institution of suits and not to appeals. Since the primary suit was filed and determined in the Mombasa Chief Magistrate’s Court and the subject matter is land situated in Mombasa, the appeal should be heard in Mombasa. Administrative inconveniences or delays do not constitute sufficient legal grounds for transfer. The application was therefore dismissed.
