The application is based on the following grounds:a.That on the 9th day of May, 2025, the Honorable Court issued Grant of letters of Administration to Annah Jepkoech Towei And Elizabeth Chepkiyen Juma In Respect Of The Estate Of Kibungei Keter Kibungei (Deceased) who died on the 8th day of February 2015 at Simat.b.That there is no application for dependents pending herein.c.That the statutory six months’ period required before confirmation has since not lapsed after the issuance of the Grant of letters of Administration and the petitioners will seek leave for confirmation of grant before the lapse of the said period.d.That the applicants have obtained necessary consent for confirmation of grant and consent for mode of distribution in respect of this succession Cause.e.That no objection whatsoever has been lodged in respect to this cause. 2.In support of the application is the annexed affidavit of Annah Jepkoech Towei and Elizabeth Chepkiyen Juma who deponed as follows:a.That a grant of letters of administration of the said estate was made to us in this matter by the High Court of Kenya at Eldoret, On 9Th May,2025.b.That we do swear this oath on our own behalf as the the Constitution of Kenya, 2010, which promotes the use of Alternative Dispute Resolution mechanisms as part of resolving cases in our justice system. Rule 34 of the Court-Annexed Mediation Rules, 2022, completes the scheme by requiring the Court to adopt a duly executed settlement and to enter it as an order. Having examined the agreement filed herein, taken note of the signatures of the petitioners, the respondents, the family representatives of the deceased beneficiaries and the two buyers, and accepted the parties' express declaration that they entered it without force, coercion or undue influence, I am satisfied that the agreement reflects the family's settled will. I find nothing in it that offends the Law of Succession Act, Cap 160, or that is contrary to public policy. 5.In the result, the Mediation Settlement Agreement entered into in this cause is adopted in its entirety as the judgment of this Court. The grant of letters of administration intestate issued on 9th May 2025 shall be amended to issue jointly in the names of Annah Jepkoech Tuwei, Elizabeth Chepkiyeny Juma, Salome Chesang Bitok and Kiplangat Bungei Letongwa, who shall hold and administer the estate as joint personal representatives. The estate of the late Kibungei Keter Kibungei shall be distributed strictly in the terms agreed by the parties. 6.The Deputy Registrar shall generate a certificate of confirmation in the said terms. 7.Orders accordingly.
