Ratio Decidendi

The High Court found that the trial magistrate erred in applying the multiplier approach to assess loss of earning capacity, given the lack of clear evidence of the respondent's earnings. The court held that a global sum was more appropriate in the circumstances. The award for pain and suffering was also found to be inordinately high compared to comparable cases. The court reduced the award for pain and suffering to Kshs 2,500,000 and for loss of earning capacity to Kshs 1,500,000, holding that these amounts were fair and commensurate with the injuries and prevailing legal principles. Each party was ordered to bear their own costs.
