The Court held that the threshold for an arguable appeal is not high and does not require the appeal to be likely to succeed, only that it is not frivolous. The Court further held that the subject property should be preserved to prevent the appeal from being rendered nugatory, as the sale would defeat the purpose of the appeal if it ultimately succeeded.
