Ratio Decidendi

The court found that the plea was unequivocal, taken in a language the appellant understood, and the procedure for plea taking was properly adhered to. However, the trial magistrate erred in imposing a default sentence of two years imprisonment for non-payment of the fine, as the Wildlife Conservation and Management Act, 2013, does not provide for a default sentence. Instead, the Penal Code's scale should have been applied, resulting in a maximum default sentence of 12 months imprisonment per count. The appeal therefore succeeded only to the extent of correcting the default sentence, while the conviction and the fines imposed remained undisturbed.
