Although Order 5 Rule 1(6) of the Civil Procedure Rules, 2010 provides that failure to collect summons within thirty days results in abatement of the suit, the Tribunal found that the Respondent had been served with the Statement of Claim and Application and had actively participated in the proceedings, including an appeal. The Respondent did not demonstrate any legal or equitable prejudice suffered due to the non-service of summons. The Tribunal exercised its inherent powers under Rule 3 of the Co-operative Tribunal (Practice and Procedure) Rules, 2009 and Article 159(2)(d) of the Constitution to disregard procedural technicalities in favor of substantive justice.
