Ratio Decidendi

The court found that the plaintiff died on 24th June 2000 and, despite notice and intention to substitute, no application for substitution of the legal representative was made within the statutory period of one year. The allegations of death and non-substitution were uncontroverted. Under Order XXIII Rule 3(2) of the Civil Procedure Rules, the suit automatically abated after the lapse of one year without substitution. The court therefore held that the suit had abated and awarded costs to the defendant, recoverable from the estate of the deceased plaintiff.
