The court found that, given the substance of the protest and the fact that the 1st respondent's averments were not controverted by the applicants, it would be premature to grant the order for demolition of the alleged illegal structures at this interlocutory stage, as it could pre-empt the outcome of the protest. However, to preserve the estate and prevent further intermeddling or alienation, the court granted an order restraining the respondents from undertaking any further construction or dealing with the estate property pending the final determination of the protest. Costs were ordered to be in the cause.
