R U L I N G
This application is dated 6th October, 2015 and seeks orders that:-
1. JOSECK NJERU JOHN being the legal representative of the deceased plaintiff be made a party to this suit and proceed with the same.
2. Costs be in the cause.
The application is supported by the Affidavit of JOSECK NJERU JOHN and has the following grounds:-
1. The Plaintiff is now deceased.
2. The cause of action survives the death of the Plaintiff.
3. The applicant has been appointed the legal representative of the deceased plaintiff for purposes of prosecuting this suit.
When the matter came up for directions on 10/05/2016, it transpired that the application was not opposed. In the circumstances , it is allowed. Costs shall be in the cause.
It is directed as follows:-
1. The Plaintiff to fully comply with Order 11, CPR within 30 days of today.
2. The defendant to comply with Order 11 CPR, within 30 days of receipt of the Plaintiff's compliance documents.
3. Directions on 11/07/2016.
