The other grounds required ascertainment of facts and could not be determined as preliminary objections. Upon examining the limitation issue, the court held that the cause of action accrued on 20th April 2005, when the plaintiff gave notice to the defendants to vacate the property. Since the suit was filed on 14th June 2016, it was within the 12-year limitation period prescribed by Section 7 of the Limitation of Actions Act.
