The court found that the plaintiff's equity of redemption was extinguished once the 1st defendant, as chargee, entered into a valid sale agreement with the 2nd defendant in exercise of its statutory power of sale. The issue of whether statutory notice was served had already been determined in a previous suit and was therefore res judicata. Even if the Land Control Board consent was obtained outside the statutory period, the court lacked jurisdiction to nullify it except through judicial review.
