Ratio Decidendi

The court found that the Mathira Land Disputes Tribunal exceeded its jurisdiction by determining a dispute involving trust and ownership of registered land, matters which are not within the scope of section 3(1) of the Land Disputes Tribunal Act. The Tribunal's award, which purported to subdivide registered land and recognize a trust, was ultra vires and a nullity. The proper forum for such disputes is a civil court of competent jurisdiction. Consequently, the proceedings and award of the Tribunal, as well as the judgment and decree of the Karatina Principal Magistrates Court based thereon, were quashed by an order of certiorari.
