Ratio Decidendi

The court found that while the applicant's counsel was properly served with the hearing notice and the proceedings were regular, it was possible that the applicant was not informed of the hearing date due to the counsel's failure. Recognizing the principle that mistakes of counsel should not be visited upon the litigant and the importance of the right to be heard, the court exercised its discretion to set aside the judgment. However, given that the respondent had incurred costs due to the applicant's absence, the setting aside was made conditional upon the applicant paying throw away costs of KShs. 40,000 within 14 days. Failure to pay would result in the judgment remaining in force.
