In such circumstances, the appeal is deemed abandoned. The Court exercised its inherent jurisdiction under Rule 1(3) of the Court of Appeal Rules to dismiss the appeal against the 1st respondent for non-prosecution, as the appellant's advocate declined to make submissions or proceed with the appeal. The appeal against the 2nd respondent had already abated due to death and lack of substitution. Thus, the appeal was dismissed with costs to the 1st respondent.
