The Court of Appeal held that the purported removal of the Mayor of Nairobi and the subsequent elections conducted at the council meeting of 20th April 1994 were null and void. The meeting was convened for an unlawful purpose, namely to discuss the conduct of the Mayor without complying with mandatory standing order 42, which required written accusations to be referred to the appropriate committee.
