The court declined to grant the substantive orders sought by the applicant because the interested party, Kanyi Gichuhi, was not properly enjoined as a party to the proceedings and was therefore a stranger to the suit. The decree previously issued only involved the applicant and the respondent. The transfer of the suit land to the interested party during the pendency of the suit was found to be a deliberate attempt to frustrate the applicant, but the court could not issue orders affecting the interested party's title without due process.
