The Defendant acquired title during the pendency of the previous suit and with knowledge of the Plaintiff's occupation, thus could not claim to be a bona fide purchaser for value without notice. The court held that the Plaintiff's rights by adverse possession had accrued and were not defeated by the subsequent transfer of title to the Defendant.
