Ratio Decidendi

The Court found that, based on certified copies supplied by the Court to the Respondent, the Statements of Claim in all seven files were not signed at the time of filing. The Court concluded that the Claimants' Advocates attempted to remedy the default by signing some Statements of Claim after the issue was raised, but this did not cure the original defect. The absence of the Advocates' signatures at the time of filing rendered the Statements of Claim formally invalid in law. Consequently, the Court held that the Claims must be struck out for failure to comply with the mandatory procedural requirement under Rule 6(a) of the Employment & Labour Relations Court (Procedure) Rules 2016.
