The court found that the Magistrates Court retains jurisdiction to hear and determine matters relating to environment, use, occupation, and title to land that were pending before it at the time the Environment and Land Court was operationalized, as well as those transferred from the defunct Land Disputes Tribunals and new matters within its pecuniary jurisdiction. The Chief Justice’s Practice Directions explicitly provide for this continued jurisdiction. The Environment and Land Court is not the trial court for the matters in question and therefore cannot order their consolidation or transfer.
