The court found that the applicant, being a layman and not an advocate, lacked the requisite knowledge and capacity to depone to matters concerning the taxation of advocate's costs. The affidavits filed did not comply with Order 19 Rule 3 of the Civil Procedure Rules, as they were not confined to facts within the deponent's own knowledge and failed to disclose the sources and grounds of information. The affidavits were therefore fatally defective and inadmissible. Consequently, the application was rendered incompetent for lack of proper supporting affidavits, and the preliminary objection was upheld.
