Legal Issues
- 1 Whether the petitioner is entitled to a review or reduction of sentence after serving 16 years for robbery with violence.
- 2 Whether the petitioner should be conditionally released from prison.
Ratio Decidendi
The court found that the petitioner, having served 16 years imprisonment for robbery with violence involving KES 92,000 and causing harm, has paid his debt to society. The court exercised its discretion to resentence the petitioner to the period already served and ordered his conditional release, subject to reporting requirements for one year. The decision was based on the principles of proportionality, rehabilitation, and the interests of justice, balancing the gravity of the offence with the time already served and the petitioner's conduct.
Court Disposition
petition allowed in part; petitioner resentenced and conditionally released
Orders
- The petitioner is resentenced to serve 16 years in jail.
- Having served 16 years, the petitioner is forthwith released from jail on condition that he reports to Naivasha Police Station on every 1st day of the month for one year beginning 1/11/2020.

JUDGMENT
I have considered the Petitioner's submissions and those of the state. The Petitioner was charged with robbery with violence and has spent 16 years in jail. He robbed 92,000/= and caused harm to the victim.
I think the Petitioner has paid the debts to society, and is entitled to conditional discharge from prison.
I therefore make the following orders:-
1) The Petitioner is hereby re-sentenced to serve 16 years in jail.
2) Having served the said 16 years, the Petitioner is herewith forthwith released from jail on the following conditions.
(i) The Petitioner shall report to Naivasha Police Station on every 1st day of the month for a period of one (1) year beginning 1/11/2020
(ii) At the end of one year the Naivasha Police Station shall file a report in this court on the Petitioner, who shall then be free.
