The court found that the orders given in the judgment of 30th January 2015 were not conclusive and had led to divergent interpretations by the parties, resulting in further disputes. Guided by the Civil Procedure Act and Rules, as well as relevant case law, the court held that review of the orders should be made only by the judge who delivered the original judgment. The court agreed with the defendants that only Hon. Lucy Waithaka, J, who heard the case and delivered the judgment, was best placed to interpret her own decision and issue any further orders.
