The appellate court found that the trial magistrate erred in attributing liability to a party not joined to the proceedings, namely the motorcycle rider, when the respondent had failed to successfully institute third party proceedings as required by Order 1 Rule 15 of the Civil Procedure Rules. In the absence of the third party, the respondent was to shoulder full liability for the accident. The court further held that the quantum of damages proposed by the trial court was inordinately low in light of the injuries suffered by the appellant and comparable awards in similar cases.
