Procedural Posture

Civil Case / Judgment

  1. 1 Whether the partnership between the plaintiff and defendant should be formally dissolved.
  2. 2 How the funds held in the partnership bank account should be distributed.

Ratio Decidendi

The court found that both parties were in agreement that the partnership should be dissolved and that the only outstanding issues were the formal dissolution and the distribution of the funds held in the partnership's bank account. Since the partnership had ceased operations and there was no point in maintaining a dormant partnership, the court ordered its dissolution. The funds held at Barclays Bank, together with accrued interest, were to be shared equally between the plaintiff and the defendant. The court also considered the familial relationship between the parties and the fact that both sought similar relief, and therefore ordered each party to bear their own costs.

Court Disposition

partnership dissolved; funds to be shared equally; each party to bear own costs

Orders

  • The partnership between the plaintiff and defendant is dissolved.
  • The funds held at Barclays Bank, together with accrued interest, shall be shared equally between the plaintiff and defendant.
