The court held that the Bahati Land Disputes Tribunal acted ultra vires its statutory mandate by adjudicating on matters of inheritance and ownership of registered land, which are expressly outside its jurisdiction as set out in Section 3(1) of the Land Disputes Tribunal Act. The tribunal's decision to compel the applicant to transfer land to the interested parties was null and void, as only the High Court or, in limited circumstances, the Magistrate's Court has jurisdiction over such matters under the Registered Land Act. Furthermore, the Law of Succession Act only applies upon the death of the property owner, and the applicant was still alive; thus, no cause of action under succession...
