The delay of about two months was not considered undue or unreasonable. The draft memorandum of appeal disclosed arguable grounds, justifying the grant of leave to appeal out of time. However, since the judgment appealed from was a dismissal with no positive order capable of execution, the court held that a stay of execution could not be granted.
