Ratio Decidendi

The court found that if the appellant were to serve a jail term for contempt before the appeal is determined, and the appeal ultimately succeeds, the outcome would be rendered nugatory as it would be impossible to undo a jail term already served. The court was satisfied that the risk of substantial loss within the meaning of Order 42 Rule 6(2) had been demonstrated. Accordingly, the court exercised its discretion to grant a stay of execution of the contempt order pending the hearing and determination of the appeal, subject to the appellant filing and serving the record of appeal within 45 days.
