Ratio Decidendi

The court found that the plaintiffs failed to satisfy the requirements for review under Order XLIV rule 1 of the Civil Procedure Rules, as they did not present any new or important matter or evidence unknown at the time of the original application. Further, under section 77(3) of the Registered Land Act, any remedy for irregular exercise of the statutory power of sale lies in damages against the person exercising the power (ICDC), not against the purchaser at auction. There was no legal basis for joining Reuben Musyoki Muli as a party, as the plaintiffs had no cause of action against him. The application for review and joinder was therefore dismissed with costs.
