Ratio Decidendi

The court found that although there was a significant delay and lack of prosecution by the Plaintiff, the Defendant had taken a step in the proceedings by filing a defence and related documents shortly before the dismissal. The court noted that the Plaintiff's counsel had received notice of the hearing but failed to explain the absence. However, in the interest of justice and considering the Defendant's recent activity in the case, the court exercised its discretion to set aside the dismissal and reinstate the suit, subject to the Plaintiff paying throw away costs to the Defendant within 30 days. Failure to comply would result in the reinstatement order lapsing automatically.
