Ratio Decidendi

The court found that the Applicant had been in open, actual, continuous, and uninterrupted possession of the entire suit land for more than twelve years, as confirmed by both the Applicant’s and Respondent’s witnesses. The Respondent did not take any legal action to evict the Applicant during this period. The Applicant’s occupation was not by permission but was adverse and hostile to the Respondent’s title. The court held that the Applicant had satisfied the legal requirements for adverse possession under Section 7 of the Limitation of Actions Act. Accordingly, the Applicant was entitled to be registered as the proprietor of the suit land, and the Respondent’s rights were extinguished.
