The Court found that while it retains jurisdiction to hear matters arising from employment relationships, including work injury claims, the effect of Gazette Notice No. 9342 of 2011 (issued under now-repealed Section 16(2) of the Labour Act) is that Magistrates Courts retain jurisdiction to handle work injury cases. Since the subsidiary legislation has not been revoked, the Magistrates Courts' jurisdiction remains valid. Exercising judicial discretion, the Court referred the matter to the Chief Magistrate's Court at Nairobi for hearing and determination under the jurisdiction conferred by the Gazette Notice, rather than proceeding in the Employment and Labour Relations Court.
