The High Court is not functus officio in respect of an application for refund of excess decretal sums paid pursuant to a decree that was subsequently varied by the Court of Appeal. The doctrine of functus officio does not preclude the court of origin from enforcing or implementing the appellate court's decision, especially where the excess funds were paid out under its own orders. The application is not res judicata as the issue of refund of excess decretal sum was not previously litigated or finally determined between the parties. The defendant is entitled to a refund of the excess sum paid to the plaintiff, together with interest at court rates from the date of receipt by the plaintiff...
