No application for extension of time to file the notice of appeal out of time had been made to the Court of Appeal. As a result, there was no valid or pending appeal before the Court of Appeal. The court concluded that it could not grant a stay of execution in the absence of a competent appeal or an application for extension of time. The application for stay of execution was therefore incompetent and was dismissed with costs to the plaintiff.
