The Claimant failed to establish a prima facie case as required under the Giella principles, since there was no consensus on the outstanding loan amount and no evidence of entitlement to a three-month notice. However, the Tribunal held that if the property were sold and it was later found that the Claimant owed a lesser amount, irreparable loss would result.
