Ratio Decidendi

The court found that the tenant was duly served with the landlord's notice of motion and failed to file any response or attend court. In accordance with Section 10 of Cap 301, the landlord's notice to terminate tenancy took effect from 1st January 2021, as the tenant did not oppose or refer the matter to the tribunal. The landlord's application was therefore unopposed and allowed in full, including orders for the tenant to vacate, payment of rent arrears, and authorization to levy distress for rent.
