The reports produced by these officials established that there was encroachment on the road reserve by the plaintiff, and recommended removal of the encroaching trees and fence to maintain a six-metre wide road. With the plaintiff's suit dismissed for want of prosecution and no evidence to the contrary, the court saw no reason to deny the defendant's claim. The court therefore ordered implementation of the recommendations in the Land Registrar's and County Surveyor's reports as prayed in the counterclaim.
