The court found that the prosecution had proved the elements of defilement beyond reasonable doubt: the complainant was under 18 years old, penetration was established through her testimony and medical evidence, and the appellant was positively identified as the perpetrator. The appellant's defence was found to be incredible and unsupported by evidence. However, the trial magistrate erred by imposing a sentence above the statutory minimum without providing reasons. The appellate court revised the sentence to the statutory minimum of 20 years’ imprisonment, to run from the date the appellant was remanded in custody.
